Can i pursue legal action?

This is all wrong. First of all I would call the Realtor board (yellow pages) and file a formal complaint. Ask them if they can help you get your money back. They you can take her to small claims court yourself for a small court fee. Keep all your evidence: receipt, phone log, copy of emails, etc. Anything that will prove your case. She is the wrong one.
